2. Use of Our Website
You may use our website for lawful purposes only. You may not:
Attempt to gain unauthorised access
Disrupt or interfere with systems
Use the website for fraud, spam, or unlawful activity
Copy, scrape, or resell website content without permission
We may suspend or block access if abuse is detected.
3. Quotes and Pricing
All quotes provided by Orlik IT:
Are valid for 14 days unless stated otherwise
Are subject to availability
Exclude VAT unless otherwise stated
Pricing may change due to:
Supplier price changes
Exchange rate fluctuations
Scope changes
Urgent or after-hours work
4. Service Delivery
We will provide services in a professional and commercially reasonable manner.
However, Orlik IT cannot guarantee:
100% uptime
That third-party systems (Microsoft, Google, hosting providers, etc.) will never fail
That cyber threats can be eliminated entirely
We will always act in good faith to resolve issues.
5. Client Responsibilities
You agree to:
Provide accurate and complete information
Maintain valid licences for software
Use systems lawfully
Maintain your own backups unless contracted otherwise
Protect your passwords and user access
Orlik IT is not responsible for loss caused by:
Client negligence
Weak passwords
Malware introduced by users
Unlicensed or pirated software
6. Payment Terms
Unless otherwise agreed:
Invoices are payable within 7 days
Overdue accounts may result in service suspension
Hardware and software must be paid before delivery
Late payments may incur:
Interest
Legal recovery costs
7. Intellectual Property
All intellectual property developed by Orlik IT (including scripts, systems, documentation and designs) remains the property of Orlik IT unless otherwise agreed in writing.
Clients receive a licence to use deliverables for their business.
8. Limitation of Liability
Orlik IT is not liable for:
Loss of profits
Loss of data
Business interruption
Indirect or consequential damages
Failures caused by third-party providers
Our total liability is limited to the value of the services paid in the preceding 3 months.
9. Data Protection
We comply with the Protection of Personal Information Act (POPIA).
Personal data is handled in accordance with our Privacy Policy.
10. Suspension or Termination
We may suspend or terminate services if:
Payment is overdue
Systems are abused
Illegal activity is detected
Security risks exist
Clients may cancel services with written notice, subject to contractual terms.
11. Force Majeure
We are not liable for failure to perform due to:
Power outages
Internet failures
Cyber attacks
Natural disasters
Government action
Supplier outages
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any disputes will be handled in South African courts.
13. Changes to These Terms
We may update these Terms from time to time.
